How long before a dispute is finalised through mediation?
From the time the parties commence with a pre-mediation meeting, until the finalisation of the dispute takes approximately 2-3 weeks, depending on the availability of the parties.
How much does a mediation cost?
Depending on the the length and venue of the mediation, the costs in most instances vary between R10 000.00 and R20 000.00 per party. Should a party make use of legal representation during the mediation, those costs will be additional.
Must my lawyer be present?
That depends wholly on the parties. The parties can agree to have legal representation present should they want. It often assist parties to receive legal advice during the mediation proceedings.


Is mediation the same as settlement negotiations?
Mediation is not the same as settlement negotiations or a so-called "roundtable meeting". During a roundtable meeting, the legal representatives of the parties negotiation on behalf of their client.

Is mediation the same as arbitration?
Mediation and arbitration are completely different. Arbitration is much like litigation (going to court) and is a process where a presiding official considers the evidence and determine which party proved his or her case.
